How to Respond to an Indore Municipal Corporation Notice

On receiving a notice from the Indore Municipal Corporation, note the compliance period, which is often only three to seven days. Obtain the file referred to in the notice, file a written reply within that period enclosing the sanctioned plan, permission and title documents, and do not let the period expire. The position after the Corporation has acted is far weaker than before.

How much time is given in a municipal notice at Indore?
It varies with the nature of the notice. Notices for removal of encroachment or unauthorised construction commonly allow three to fifteen days. Show cause notices on assessment or licensing may allow longer. The period stated in the notice itself is the operative one, and it should be treated as firm.
What happens if the notice is ignored?
The Corporation may proceed to act on the expiry of the period, which in removal matters means demolition or removal of the structure. Once that has happened, the remedy shifts from preventing the action to challenging it and claiming consequential relief, which is a slower and less satisfactory proceeding.
Can a court stay a municipal demolition notice?
A court may grant interim protection, but it will look closely at whether the party replied to the notice, whether the construction was authorised, and whether the party approached the court promptly. Approaching the court without having filed a reply, or after a long delay, materially weakens the application.
Does a property tax receipt prove that construction is authorised?
No. Payment of property tax establishes that the Corporation has assessed and taxed the property. It does not establish that the construction was raised with sanction or in accordance with a sanctioned plan. Tax receipts are useful evidence of possession and of the period of existence of the structure, but they are not a substitute for building permission.
